Welcome to Daffaa. These Terms of Use ("Terms") govern your access to and use of our website, dashboard, mobile applications, APIs and related services (together, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Daffaa provides merchants with tools to accept payments by automatically reading e-wallet SMS confirmations on a connected Android device and matching them to orders in the merchant's store. The Service includes a dashboard, payment pages, APIs, webhooks and reporting tools.
2. Accounts and eligibility
- You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.
- You agree to provide accurate, current and complete information during registration and to keep it up to date.
- You are responsible for all activity that occurs under your account, including activity by your staff members and connected devices.
- You must keep your password and access credentials secure and notify us immediately of any unauthorized use.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent or harmful purpose.
- Process payments for prohibited goods or services, including (without limitation) illegal substances, weapons, adult content, pyramid schemes, or any activity that violates applicable laws or payment-network rules.
- Attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service or its underlying systems.
- Interfere with the SMS-reading device, manipulate payment confirmations, or submit forged transactions.
- Resell or sublicense the Service without our prior written consent.
We may suspend or terminate accounts that violate these rules, with or without notice, and may report violations to the relevant authorities.
4. Plans, fees and billing
- Use of the Service is subject to the subscription plan you select. Plan features, prices and limits are shown on the pricing page and may change from time to time.
- Fees are billed in advance for the selected period and are non-refundable except where required by law or expressly stated in our Refund Policy.
- You authorize us to charge your selected payment method for all fees due. If a charge fails, we may suspend your account until payment is received.
- Taxes, transaction fees charged by payment networks or telecom operators, and SMS-related costs are your responsibility unless stated otherwise.
5. SMS device and connectivity
The Service depends on an Android device that you control, with our companion application installed and an active SIM that receives e-wallet SMS confirmations. You are responsible for keeping the device powered, connected to the internet, and in a state where it can read incoming SMS messages. We are not liable for missed or delayed transactions caused by device failure, network outages, or carrier issues outside our control.
6. Customer transactions and refunds
You are solely responsible for the goods or services you sell, for fulfilling customer orders, and for handling customer support, refunds, chargebacks and disputes related to your transactions. Daffaa acts only as a technology provider that confirms incoming payments — we are not a party to the underlying sale between you and your customer.
7. Intellectual property
The Service, including all software, designs, trademarks, logos and content (excluding your data), is owned by Daffaa or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify or create derivative works of the Service except as expressly permitted.
8. Your content and data
You retain ownership of the data you upload or generate through the Service ("Your Data"). You grant us a worldwide, royalty-free license to host, process and transmit Your Data solely as needed to provide the Service, prevent fraud, and comply with our legal obligations. Our handling of personal data is described in our Privacy Policy.
9. Third-party services
The Service may interoperate with third-party services such as e-wallet providers, telecom operators, hosting providers and analytics tools. We are not responsible for the availability, accuracy or terms of such third-party services, and your use of them may be subject to separate agreements.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY SMS WILL BE DELIVERED, MATCHED OR CONFIRMED.
11. Limitation of liability
To the maximum extent permitted by law, Daffaa and its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold Daffaa harmless from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.
13. Suspension and termination
You may stop using the Service at any time by closing your account from the dashboard. We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees, or if continued provision of the Service would expose us or other users to legal or operational risk. Upon termination, your right to use the Service ends immediately, but provisions that by their nature should survive (including intellectual-property, disclaimers, limitations of liability and dispute resolution) will continue to apply.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Cairo, Egypt.
